 Congressman Steve Cohen from Tennessee states in his letter to Drug Czar Gil Kerlikowske that, "There is no evidence that marijuana has the same addictive qualities or damaging consequences as these harder drugs and it should not be treated as such." He goes on to explain how drug convictions for non-violent possession "crimes" have high costs - almost $7.6 billion per year is estimated to be spent on marijuana arrests and prosecutions. He also states that the damage to ruining someone's life with an unnecessary conviction is an unreasonable cost to our society, dooming these people to "second-class citizenship". He mentions the "disastrous racial disparities" in the criminal justice system, reporting that African-Americans and Latinos are much more likely to be arrested for marijuana possession than whites.

Congressman Cohen also addresses states' rights to make their own medical marijuana laws, stating, "We should not deny the thousands of Americans who rely on the benefits that marijuana provides. I strongly recommend that this administration allow states that have chosen to legalize medical marijuana to enact strong regulations without fear of prosecution. [W]e should not interfere with the will of the people to enact these compassionate laws."

The diabolical essence of the argument is that marijuana is not as bad as alcohol OR tobacco. That's not true. It's as bad as alcohol AND tobacco. Everything bad about alcohol is bad about marijuana, AND everything bad about tobacco is bad about marijuana.

Marijuana fails the medicine test as well. Can you smoke in a hospital? Nope.
Can you drink a rum and coke in a hospital? Nope. So, if marijuana is comparable to tobacco and alcohol, then it's not a medicine.

Congressman Cohen is also an idiot concerning the sale of illicit drugs and states rights. The commerce clause specifically grants the Federal Government the power to say what may or may not be sold in order to keep the States being good neighbors.

Let me make an example, admittedly an extreme one but one which will get the point across...

Let's say that Arizona is a State full of gun-crazed maniacs (okay, that's not much of a stretch). And lets say that California is a State full of gun control nuts (not much of a stretch either). Now, disregarding Federal Firearms Laws, the State of Arizona legalizes the sale and use of fully automatic weapons (machine guns, not to put too fine a point on it).

California says "HOLY CRAP!" because every last one of their drug gangs immediately run to Arizona gun stores, stock up on machine guns which can shoot a thousand rounds per minute, and California cops get into shootouts that make their 9mm Glocks look like BB guns.

If California complains that Arizona is violating Federal Law by allowing the unrestricted sales of machine guns, then does California have a valid complaint? Does the Federal Government have the authority to tell Arizona to cease and desist? I'd say they do!

So what's the difference with Marijuana legalization? Is there a danger? Yes, there is.

Let's flip-flop the scenario for marijuana. California legalizes marijuana, and Arizona doesn't. I live in Phoenix, about 350 miles from San Diego. I could eat breakfast in Phoenix and have dinner in San Diego, a one day drive.

What's the danger? Arizona kids could (and would) go to California to get stoned quasi-legally and then try to drive back 350 miles under the influence. They're pretty well likely to get themselves killed in the attempt. I do not want to see kids drive 350 miles stoned.

This explains the national drinking age of 21. States with higher drinking ages bordered states with lower drinking ages, and what happened? Predictably, the kiddies in a State with a drinking age of 21 lived near enough to a State with a drinking age of 18 that they'd drive across the State line, party hearty on Whiskey Row and then try to drive their besotted asses back home. The kids' home States complained (and rightly so) that their neighbors bad laws were getting their kids killed.

This is the wisdom in having the Federal Government empowered with the Commerce Clause. It makes for good neighbors between the contiguous States.
